On December 29, 2022, U.S. President Biden signed into effect the Modernization of Cosmetics Regulation Act of 2022. MOCRA for short. This new legislation amends the requirements of the Federal Food, Drug, and Cosmetic Act.

What does MOCRA provide?

MOCRA provides the FDA with significant new powers and places several new requirements on the cosmetic industry. Mandatory registration of all existing facilities manufacturing or processing cosmetic product for distribution, in the US, must register by December 29, 2023. New facilities that open after this date, must register within 60 days of the commencement. 

One of the most significant new requirements on the cosmetics industry includes the development of Good Manufacturing Practices (GMPs). Additional requirements include: Facility registrations and inspections, adverse event reporting, records review, and mandated product recalls. 

MOCRA also introduces new obligations for the Responsible Person. The Responsible Person is defined as the manufacturer, importer, packer or distributor of a cosmetic product, and whose name appears on the product labeling.
